As part of our services to our insurance and reinsurance clients we offer a specialist subrogation service. Our aim is to achieve for clients the most efficient and cost effective insurance and reinsurance recoveries, either augmenting or working in tandem with existing claims departments We generally recommend the following approach: We review a client’s claim files, to identify:- a. files where there is a strong prospect of recovery b. files where prospects are reasonable c. files where prospects are uncertain because further enquiry is required   i. into the facts   ii. into the third party’s assets d files where recovery is not available or not viable and may be closed • On the basis of the review analysis, we agree, with the client’s claims department, which of the files identified under (b) above are to be pursued • Working with associated companies in the loss adjusting, reinsurance investigation and asset tracing fields, we carry out the further enquiries necessary to identify the recovery status of the files identified under (c) above. Where this involves expenditure, full details are provided to the client • In respect of all files where recovery is to be pursued or is the subject of consideration as to the cost effectiveness of pursuit, careful consideration is given to the most cost efficient means and forum to be used - negotiation, conciliation, mediation, litigation, arbitration, or, what, in our experience, can be surprisingly effective, exploitation of market contacts, on an agreed form of bordereaux
